Terms of Service

These Terms of Service ("Terms") govern your use of the BIMFalcon.com website and the FalconTools software product ("Service") operated by BIMFalcon ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using FalconTools, or by accessing BIMFalcon.com, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Description of Service

FalconTools is a productivity add-in for Autodesk Revit that provides tools for room numbering, door tagging, type importing, elevation cropping, and more. The Service is offered in multiple tiers:

• Starter (Free): Core room and door numbering tools, plus 10 free uses of Professional-tier tools. After 10 uses, Professional tools are disabled until a paid license is activated.
• Professional ($149/year): Unlimited access to all 10 tools, email support, and free updates.
• Team ($399/year): Everything in Professional for up to 5 seats, with priority support, volume licensing, and onboarding.

3. Account and Registration

Some features may require you to provide contact and billing information. You agree to:

• Provide accurate and complete information.
• Keep your license key confidential and not share it with unauthorized users.
• Notify us promptly of any unauthorized use of your license.

4. Payments and Billing

• Paid plans are billed annually from the date of purchase.
• All prices are in US dollars and are subject to change with 30 days' notice.
• Payment is processed through our third-party payment provider.
• Licenses are non-transferable unless explicitly authorized by BIMFalcon.

5. Refunds

If you are not satisfied with your purchase, you may request a full refund within 30 days of the original purchase date by contacting support@BIMFalcon.com. Refunds are not available after 30 days.

6. Permitted Use

You may use FalconTools for lawful commercial and personal purposes in accordance with your license tier. You agree not to:

• Reverse engineer, decompile, or disassemble the software.
• Modify, adapt, or create derivative works based on the software.
• Redistribute, sublicense, rent, or lease the software to third parties.
• Remove or alter any proprietary notices or labels.
• Use the software to develop a competing product.
• Attempt to circumvent license restrictions or usage limits.

7. AI Model Query Terms (Planned Feature)

Model Query is a planned feature that will use third-party AI services (Anthropic's Claude API). When this feature becomes available, by using Model Query you will acknowledge that:

• Query data will be sent to external servers for processing.
• AI responses are generated automatically and may not always be accurate.
• You are responsible for verifying AI-generated information before relying on it for design, engineering, or compliance decisions.
• BIMFalcon is not liable for decisions made based on AI-generated responses.

8. Intellectual Property

FalconTools, including all code, design, documentation, and branding, is the exclusive property of BIMFalcon and is protected by copyright and intellectual property laws. Your license grants you a right to use the software, not ownership of it.

9. Third-Party Trademarks

Autodesk, Revit, and related trademarks are the property of Autodesk, Inc. FalconTools is an independent product and is not affiliated with, endorsed by, or sponsored by Autodesk, Inc.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BIMFALCON DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIMFALCON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless BIMFalcon from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. Upon termination:

• Your license to use FalconTools is immediately revoked.
• You must uninstall and destroy all copies of the software.
• Sections regarding liability, indemnification, and intellectual property survive termination.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on our website at least 30 days before taking effect. Continued use of the Service after changes constitute acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
